1. Acceptance of Terms
By accessing or using the website xcelpadel.com, mobile or web applications, and related services (collectively, the “Services”), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use the Services.

 

2. Company Information
The Services are operated by Xcel Padel LLC, located at:

3. Eligibility
To use our Services, you must be at least 18 years old or have the permission and supervision of a parent or legal guardian.

 

4. Services Provided
Xcel Padel provides:

  • Padel court bookings and wellness service scheduling (via Playtomic)

  • Membership purchases and exclusive offers

  • Access to events and amenities at club locations

  • Online communication through marketing platforms (e.g. Klaviyo, Meta Ads)


5. User Accounts
Some features require account registration. You are responsible for keeping your login credentials confidential and for all activities under your account.
 

6. Payments, Memberships & Refunds


6.1 Payment Processing
All payments for court bookings, memberships, wellness services, and other offerings may be processed through:

  • Playtomic (for reservations, match-related purchases, and partial memberships)

  • Stripe (for direct purchases on xcelpadel.com, including full membership plans and club credit)


By submitting payment through our website or partner platforms, you authorize us or our payment partners to charge the amount indicated at checkout using your selected method of payment.


We accept credit cards, debit cards, and other methods depending on the platform and your location.

 

6.2 Service Fees
Certain transactions may include service fees (e.g., from Playtomic). These fees:

  • Are clearly displayed during checkout

  • Are non-refundable in case of user-initiated cancellations (e.g., bookings, tournaments)

  • May be refunded only in case of automated cancellations due to court unavailability or system issues

If no service fee is shown during payment, it has likely been absorbed by the club.

6.3 Membership Purchases
Memberships (Core, Prime, Founders) purchased via xcelpadel.com include:

  • Monthly recurring charges (if applicable)

  • Tier-specific benefits and club access

  • Pre-sale price protection, as stated during checkout


All membership purchases are final and non-refundable, including initiation fees, unless stated otherwise in writing or required by law.
Founders and Prime members may receive club credit for use during off-peak hours; terms of use are published on the membership page and may be updated periodically.

 

6.4 Refunds & Cancellations
Refunds are subject to the cancellation policy of each club and the third-party platform (Playtomic or Stripe) used for the transaction.

  • For bookings made through Playtomic, the refund (if applicable) will be handled via Playtomic and follow the club’s cancellation policy.

  • For direct payments via Stripe, Xcel Padel will issue eligible refunds in accordance with our internal policy.

Please review the cancellation terms before completing your booking or purchase. If the cancellation window has passed, refunds will not be granted.

6.5 Disputes & Chargebacks
If you believe you were incorrectly charged or experience technical payment issues, please contact:

  • Playtomic bookings: support via the Playtomic app or website

  • Memberships & Stripe payments: contact@xcelpadel.com


Initiating a chargeback without contacting us first may delay or limit your eligibility for a refund.

6.6 Wallets & Credit
Xcel Padel may offer digital club credit or gift cards, which:

  • Are non-transferable

  • May expire if not used within the designated period

  • Cannot be exchanged for cash unless required by law

  • Are subject to specific usage rules disclosed at the time of issue

 

7. Booking & Cancellation
Court reservations and wellness appointments are managed through Playtomic. All booking and cancellation policies are outlined in our separate Booking & Cancellation Policy. Please review it before confirming any reservation.


8. Intellectual Property
All content on the Services, including logos, images, text, and layouts, is the property of Xcel Padel or its licensors and may not be used without permission.


9. Acceptable Use
You agree not to:

  • Violate any applicable laws or regulations

  • Interfere with the security or proper function of the Services

  • Misuse club access or facilities


Post or transmit harmful, offensive, or misleading content


10. Limitation of Liability
Xcel Padel is not liable for:

  • Injuries sustained during club activities

  • Inability to access the Services

  • Errors or interruptions in third-party platforms (e.g. Playtomic, Stripe)

Our Services are provided "as is" and "as available", with no warranties beyond those required by law.


11. Termination
We reserve the right to suspend or terminate your access if you violate these Terms, cause disruption, or engage in harmful behavior.


12. Changes to the Terms
We may update these Terms from time to time. Material changes will be posted here and, where legally required, we will notify you.


13. Governing Law
These Terms are governed by the laws of the State of Florida, USA. Any disputes shall be resolved in courts located in Miami-Dade County, Florida.
