1. Acceptance of Terms

  • By accessing or using the website xcelpadel.com, our mobile or web applications, the Playtomic booking platform, and related services (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms").

  • If you do not agree with any part of these Terms, you must not use the Services. Use of the Services (including just browsing the website or making a booking) constitutes acceptance of these Terms in full.

 

2. Company Information

  • The Services are operated by Xcel Padel LLC, a company located at: 17035 Persimmon Blvd, Westlake, FL 33470, United States.

  • For any inquiries or correspondence, you can reach us at contact@xcelpadel.com.

3. Eligibility

  • To use our Services, you must be at least 18 years old. If you are under 18, you may use the Services only with the involvement and consent of a parent or legal guardian.

  • By using the Services, you represent and warrant that you meet the applicable age requirement and have the legal capacity to enter into this agreement.

  • Xcel Padel reserves the right to refuse service, terminate accounts, or cancel bookings if we believe you do not meet eligibility requirements.

 

4. Services Provided

Xcel Padel is a premier padel club and wellness center. Our Services include, but are not limited to:

  • Padel Court Bookings & Wellness Services: Scheduling and reserving padel courts, training sessions, and wellness services (primarily through our official booking partner platform, Playtomic).

  • Memberships & Offers: Purchasing club memberships (e.g., Core, Prime, Founders plans) and accessing exclusive member benefits or promotions via our website or in person.

  • Events & Amenities: Accessing club facilities, events, tournaments, leagues, and amenities at our physical locations, subject to membership status or booking.

  • Online Content & Communications: Receiving newsletters, updates, and marketing communications (via platforms such as email newsletters, social media, or our partners like Klaviyo and Meta) if you have subscribed or given consent.

  • All Services are subject to these Terms, and certain Services may have additional guidelines or rules which, if applicable, will be provided to you (for example, specific event rules or class policies).

 

5. User Accounts

  • Creating an account may be required for certain features (such as booking a court or purchasing a membership). If you register an account with Xcel Padel (whether on our website or through a third-party platform like Playtomic), you agree to provide accurate, current information and keep it updated.

  • You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

  • You must notify us immediately of any unauthorized use of your account or any other breach of security. Xcel Padel will not be liable for any loss or damage arising from your failure to safeguard your account information or comply with this section.

 

6. Memberships, Payments, and Refunds

6.1 Payment Processing:

  • Payments for court bookings, memberships, wellness services, and other offerings are processed through our trusted partners and secure payment systems.

  • Depending on the service, payments may be handled by third-party platforms such as Playtomic (for reservations, match-related purchases, and partial membership payments) or by Stripe (for direct purchases made on xcelpadel.com, including full membership plan payments and club credit purchases).

  • By submitting a payment through our website or partner platforms, you authorize Xcel Padel and our payment processors to charge your selected payment method for the amounts due.

  • We accept various payment methods (e.g., credit cards, debit cards) as displayed at checkout and subject to availability in your region. All transactions are in U.S. Dollars (USD) unless stated otherwise.

 

6.2 Service Fees:

  • Certain transactions may include additional service fees or processing fees (for example, fees imposed by Playtomic for using their booking service). Any such fees will be clearly displayed to you before you finalize your payment.

  • These service fees, once paid, are generally non-refundable in cases of voluntary cancellation (e.g., if you cancel a booking or withdraw from a tournament).

  • Service fees may only be refunded if a booking is automatically canceled due to club issues (such as a court becoming unavailable) or technical errors on our side or that of our partners.

  • If no separate service fee is shown at checkout, any platform costs have likely been absorbed by Xcel Padel on your behalf.

 

6.3 Membership Purchases & Dues:

  • When you purchase a membership (such as Core, Prime, or Founders) through xcelpadel.com or in person, you agree to the pricing and billing terms as presented at the time of purchase.

  • Memberships may involve an initiation fee and recurring charges (monthly or annual dues, depending on the plan).

  • All membership benefits, entitlements, and club access privileges are as described in the membership materials and on our website.

  • Xcel Padel may offer perks such as exclusive booking windows, guest passes, or club credit for certain membership tiers (for example, Founders and Prime members might receive a monthly allotment of club credit usable during off-peak hours --- see membership details for current terms).

  • These perks are subject to specific usage rules which are published on our Membership page and may be updated periodically.

 

Membership Cancellation (30-Day Notice):

  • To cancel an ongoing membership, you must provide at least 30 days' written notice (e.g., via email to the club or through the member portal, if available) before your next billing date.

  • This advance notice allows us to process your cancellation before the next charge. If you provide less than 30 days' notice of cancellation, you will be billed for the next membership period (e.g., the next month) and the cancellation will take effect after that billing cycle.

  • No refunds will be provided for membership dues that have already been billed or for partial months remaining after cancellation. Initiation fees and past charges are also non-refundable.

  • In certain cases, and at our discretion, we may permit a temporary hold or pause on memberships (for example, for medical reasons or extended travel), but such a pause must be requested in advance and is governed by our club policies.

 

All Sales Final:

  • Except where expressly stated in writing by Xcel Padel or required by law, all membership sales and fees are final and non-refundable.

  • This applies to initiation fees, membership dues already paid, and one-time charges. We encourage you to review the membership details carefully before purchase.

 

6.4 Refunds & Cancellations:

Refund eligibility for bookings and services is determined by the cancellation policies of the relevant service and the platform used for booking:

  • Playtomic Reservations: If you booked a court or service through the Playtomic app/portal, any applicable refund for a cancellation will be processed by Playtomic according to Xcel Padel's club cancellation rules (see Section 7 and our Booking & Cancellation Policy). For example, if you cancel within the allowed window, Playtomic may issue a credit to your Playtomic account or a refund to your original payment method, subject to their system.

  • Direct Payments (Stripe): If you made a payment directly to Xcel Padel via our website (processed by Stripe), and you are entitled to a refund under our policies (for instance, the club cancels your booking or you canceled within an allowed period), Xcel Padel will issue the refund to your original payment method or as a credit to your club account, in accordance with our internal refund policy.

  • Please always review the specific cancellation terms presented at the time of booking or purchase.

  • If the cancellation deadline for a booking or service has passed, or if a service has already been rendered, refunds will typically not be granted.

  • Outside of our stated policies, we do not provide refunds for change of mind, dissatisfaction absent a breach of our obligations, or unused time on memberships or packages.

6.5 Disputed Charges & Chargebacks:

  • If you believe you were charged in error or encounter an issue with payments (such as duplicate charges or technical errors), please contact us first to resolve the issue.

  • For bookings via Playtomic, you may reach out through the Playtomic app support. For memberships or payments made directly to Xcel Padel, you can contact us at contact@xcelpadel.com.

  • We are committed to addressing any billing issues in good faith. Initiating a chargeback or payment dispute with your bank or card provider without first providing us an opportunity to resolve the issue may delay the resolution process and could affect your ability to use the Services.

  • We reserve the right to contest unjustified chargebacks and to limit or terminate account privileges for abuse of the chargeback process.

6.6 Wallets & Club Credit:

Xcel Padel may offer digital wallets, club credit balances, or gift cards for use at our club or on our platform. These forms of credit:

  • Are non-transferable and can only be used by the member or user to whom they were issued (unless expressly stated otherwise).

  • May have an expiration date or inactivity policy, after which unused credit may expire. We will disclose any expiration or fees associated with club credits or gift cards at the time they are issued, in compliance with applicable law.

  • Cannot be redeemed for cash, except where required by law.

  • Are subject to specific terms of use, which will be communicated when the credit or gift card is issued (for example, certain credits might only be usable for court bookings or only during off-peak hours, etc.).

  • Misuse of the payment systems or failure to pay owed fees may result in suspension of Services or other lawful remedies.

7. Booking & Cancellations

All court reservations, class enrollments, and event bookings at Xcel Padel are managed according to our Booking & Cancellation Policy, which is incorporated herein by reference. Here is a summary of key points:

  • Booking Platform: Most reservations are made through our official booking system (the Playtomic app or web portal), which shows real-time availability for courts and classes. Bookings can also be made in person at the club or by phone, subject to availability, but all bookings must be confirmed in our system and are subject to the same cancellation rules. A booking is only confirmed once the required payment has been made.

  • Cancellation Deadlines: To avoid penalties, you must cancel bookings in advance. In general, Core and Prime members must cancel at least 24 hours before the scheduled start time, while Founders members may cancel up to 6 hours before the start time without penalty (one benefit of the Founders membership is more flexible cancellation). The exact deadlines and any differences for specific programs are detailed in the Booking & Cancellation Policy. Our online system will typically prevent cancellations or modifications after the deadline has passed.

  • Late Cancellations and No-Shows: If you cancel a reservation after the applicable deadline (a "late cancellation") or fail to show up for a booking without cancellation ("no-show"), you may be charged a late cancellation/no-show fee, typically up to the full cost of the booking in question. For example, if you reserved a court or a class and did not timely cancel, you could be charged as if you had attended (since that time slot was held for you and may not have been usable by others). These fees will be charged to your payment method on file (or deducted from any credits, as applicable). Repeated no-shows or late cancellations may result in additional consequences, such as temporary suspension of advance booking privileges.

  • Refunds for Cancellations: If you cancel before the deadline, any pre-paid amount for that booking will generally be returned to you as an account credit for future use. At our discretion or where required by policy or law, refunds might be issued back to your original payment method (see our Booking & Cancellation Policy for specifics on refund methods). No cash refunds are given unless required by law.

  • Club-Initiated Cancellations: If Xcel Padel must cancel your booking (for example, due to facility issues, weather closures, or scheduling conflicts), we will notify you as soon as possible and offer either a rescheduled time, an account credit, or a full refund for that booking. We strive to avoid canceling confirmed bookings, but if it happens, we will make it right.

  • Please refer to the full Booking & Cancellation Policy for complete details. By making a booking with Xcel Padel, you agree to comply with that policy's terms regarding how to reserve, how to cancel, and any fees that may apply.

8. Code of Conduct

We expect all users and members to conduct themselves in a respectful and safe manner when using our Services or visiting our facilities. By participating in Xcel Padel activities (either online or at the club), you agree to follow our Code of Conduct, including the rules outlined below:

  • Respect for Others: Treat fellow members, guests, and staff with courtesy and respect at all times. Harassment, bullying, discriminatory language, aggressive behavior, or any form of abuse toward others is strictly prohibited.

  • Follow Facility Rules & Staff Instructions: Adhere to all posted club rules, signage, and instructions given by Xcel Padel staff or coaches. This includes observing proper court etiquette (such as rotating court time fairly if applicable, keeping courts clean, etc.) and following any safety guidelines for using equipment or facilities. If staff give specific directions (for example, regarding safety or facility use), you are expected to comply promptly.

  • Proper Attire & Equipment Use: Wear appropriate athletic attire and use any required safety gear when on the courts or in classes (for instance, non-marking shoes on the courts, protective eyewear if recommended, etc.). Use all club equipment and facilities only for their intended purposes and with care. Do not misuse, vandalize, or remove club property. If you notice any equipment that is broken or a potential safety hazard, please inform staff immediately so we can address it.

  • Alcohol & Substance Policy: If the club allows alcohol on premises (e.g., at special events or in lounge areas), it is only for adults 21+ and only in designated areas. No outside alcohol is permitted unless explicitly allowed for a private event. Intoxication or drug use is not permitted. You must not participate in any physical activity or attend the club while under the influence of alcohol, drugs, or any substance that could impair your ability to engage safely. Xcel Padel staff reserve the right to deny entry or remove any person who appears intoxicated or is engaging in unsafe behavior due to substance use.

  • Sportsmanship & Safety: Engage in fair play and good sportsmanship. Do not engage in reckless or dangerous play, cheating, fighting, or any conduct that could harm yourself or others. Be mindful of those around you on the courts and in classes; for example, avoid swinging paddles carelessly or hitting balls when someone is not ready. If you are new to the sport or a particular exercise, please seek instruction to ensure you understand the safe way to participate.

Enforcement:

  • Violations of the above Code of Conduct or any club policies may result in disciplinary action. Xcel Padel reserves the right to issue warnings, suspend or terminate your access to the club and Services, or revoke your membership for any behavior that we deem unsafe, disruptive, or inappropriate.

  • Such suspension or termination may occur without refund of any fees paid. Additionally, you will be held responsible for any damage to the facility or equipment caused by you (or by a dependent or guest under your care).

  • We appreciate your cooperation in making Xcel Padel a welcoming and safe environment for everyone.

 

9. Liability Waiver

 

Assumption of Risk:

  • By using the Services or participating in any Xcel Padel activities (including playing padel, attending fitness or wellness classes, using gym equipment, or being present at our facilities), you acknowledge that there are inherent risks of injury, illness, and property damage in these activities.

  • Padel and other sports are vigorous physical activities, and you understand that risks include, for example, muscle strains, falls, collisions with walls or other players, being hit by balls or equipment, or other accidents.

  • You voluntarily assume all risks (foreseen and unforeseen) associated with participating in activities at Xcel Padel or using our facilities, including risks that may arise from the negligence of the club or its staff to the fullest extent permitted by law.

  • You confirm that you are physically fit to participate and will use good judgment and follow safety instructions while engaging in club activities.

 

Release of Liability:

  • To the fullest extent allowed by applicable law, you hereby release, waive, and discharge Xcel Padel LLC and its owners, officers, employees, agents, instructors, contractors, affiliates, and volunteers ("Released Parties") from any and all liability, claims, demands, actions, or causes of action that may arise from your participation in club activities or use of the Services, including as a result of the ordinary negligence of the Released Parties.

  • This means that you are giving up any right to sue or claim compensation from Xcel Padel or related parties for any personal injuries, illnesses (including COVID-19 or other communicable diseases contracted at the club), death, or property damage that you may experience.

  • You intend this waiver to be as broad and inclusive as permitted by law. If any portion of this waiver is held invalid, you agree that the remaining provisions shall continue in full force and effect.

 

Indemnification:

  • You also agree to indemnify and hold harmless Xcel Padel and the other Released Parties from and against any and all claims, liabilities, losses, damages, expenses, and attorneys' fees arising out of or related to your own acts or omissions while using the Services or on club premises.

  • In other words, if your behavior or actions (or those of a minor or guest under your supervision) cause harm to someone else or damage to property, or otherwise result in a claim against Xcel Padel, you will reimburse us for any costs or damages we incur as a result.

  • This indemnification extends to claims brought by third parties and includes our costs of defending such claims.

 

Personal Property:

  • Xcel Padel is not responsible for lost, stolen, or damaged personal property. You should secure your belongings (e.g., in lockers if provided or by keeping valuables with you). Bringing possessions to the club is at your own risk.

  • If you park a vehicle on our premises, ensure it is locked and no valuables are visible; we are not liable for theft or damage to vehicles or their contents.

 

The above Liability Waiver provisions apply to the maximum extent permitted under applicable law. Nothing in these Terms is intended to waive rights or liabilities that cannot be waived under law (for example, certain liabilities arising from gross negligence or willful misconduct may not be waivable in some jurisdictions).

 

10. Media Release

  • By entering Xcel Padel premises or participating in any club events, programs, or activities, you consent to being photographed, filmed, or otherwise recorded by Xcel Padel or its authorized representatives.

  • You grant Xcel Padel the unrestricted, perpetual right to use and publish your likeness, image, voice, and/or name captured in such media for any legitimate business purpose -- including but not limited to promotional, marketing, advertising, and informational materials across all channels (for example, the club's website, social media accounts, brochures, and press releases) -- without any notice or compensation to you.

  • All photographs, videos, or recordings will be the property of Xcel Padel, and may be edited, altered, copied, exhibited, or distributed for lawful purposes as the club sees fit.

  • You waive any right to royalties or other compensation arising from or related to the use of your likeness in such media, and you release and hold harmless Xcel Padel from any claims or liabilities related to this use.

Minors:

  • If you bring a minor (under 18) to Xcel Padel or register a minor for any club services or events, you represent and warrant that you are the minor's parent or legal guardian (or have obtained the necessary consent from the parent/guardian).

  • In such cases, you consent to this media release on behalf of the minor, and the minor's presence at the club or participation in club activities is deemed parental/guardian consent for the minor to be photographed or recorded under the terms described here.

  • Xcel Padel will assume that any minor who is accompanied by, or whose membership/event registration is managed by, an adult has the appropriate legal consent for media capture and use as outlined in this Section.

 

Opting Out:

  • We understand that some individuals may prefer not to appear in photographs or videos. If you do not wish to be recorded or have your image used, you must opt out by notifying us in writing in advance (e.g. via email to the club's official contact) or informing a team member upon arrival at the club or event.

  • Xcel Padel will make reasonable efforts to accommodate opt-out requests, such as avoiding or removing images/footage of those who have opted out. Please be aware that, notwithstanding such efforts, incidental appearance in group or background shots might occur, but we will not deliberately feature anyone who has opted out in our materials.

  • In the absence of an opt-out request, your presence on club premises or participation in club activities implies your consent to this Media Release policy by default.

  • This Section 10 is intended to be globally applicable and enforceable to the fullest extent permitted by law, and it does not override any rights you may have under applicable privacy or data protection laws.

  • By agreeing to these Terms, you acknowledge that you have read and understood this Media Release clause and agree to its terms.

 

11. Intellectual Property

  • All content and materials available through our Services, including but not limited to the Xcel Padel name and logo, website design, text, graphics, images, videos, software, and any other intellectual property, are the property of Xcel Padel LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws.

  • Xcel Padel retains all rights, title, and interest in these materials.

  • You agree not to reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, or transmit any of the material on our Services without our prior written permission, except for personal, non-commercial use or as enabled by sharing features on the website.

  • No right, title, or interest in the Services or any content is transferred to you, and all rights not expressly granted are reserved by Xcel Padel.

  • Unauthorized use of our intellectual property is strictly prohibited and may violate copyright, trademark, and other laws.

 

12. Privacy & Data Handling

  • Your privacy is important to us. Any personal information you provide to Xcel Padel through the Services is subject to our Privacy Policy (see Section 17, Linked Policies).

  • We collect, process, and use personal data in order to operate and improve our Services, to process your bookings and memberships, and for other purposes as described in the Privacy Policy.

  • This may include sharing certain data with third-party providers who facilitate our Services (for example, providing your name and booking details to the Playtomic platform or using your email for sending newsletters via our email service provider).

  • By using the Services, you acknowledge and agree that Xcel Padel may collect and use your information as outlined in the Privacy Policy. We strive to implement appropriate security measures to protect your personal data, but you understand that no method of transmission over the internet or electronic storage is 100% secure.

  • We also use cookies and similar technologies on our website to enhance user experience and analyze usage, as detailed in our Cookie Policy. By using the website, you consent to our use of cookies in accordance with that policy.

  • If you are an international user, please note that your personal data may be transferred to and processed in the United States. We will handle such data in accordance with U.S. law and any commitments in our Privacy Policy. By providing your data or using our Services, you consent to such transfer and processing.

  • For full details on how we collect, use, share, and protect your information, please review our Privacy Policy. If you have any privacy-related questions or requests (such as accessing or deleting your data), you may contact us as outlined in the Privacy Policy or see Section 18 (Contact Information).

 

13. Limitation of Liability

  • To the fullest extent permitted by law, Xcel Padel and its directors, officers, employees, agents, affiliates, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages that arise out of or relate to your use of (or inability to use) the Services, any equipment or facilities at Xcel Padel, or any interactions you have with Xcel Padel or other participants.

  • This includes, for example, damages for lost profits, lost data, personal injury, pain and suffering, emotional distress, or similar harm, even if foreseeable or even if Xcel Padel has been advised of the possibility of such damages.

In addition, Xcel Padel is not liable for:

  • Personal Injuries or Property Damage that occur at the club or during participation in our activities, since by agreeing to these Terms you have accepted those risks and released us from liability as described in the Liability Waiver section.

  • Service Availability Issues, such as your inability to access or use the Services at any given time, whether due to maintenance, technical errors, or network outages. We do not guarantee that the Services will be uninterrupted or error-free.

  • Third-Party Platforms or Services that we do not fully control, including any issues arising from the use of Playtomic (our booking partner app) or Stripe and other payment processors. Any claims or disputes relating to those third-party services must be addressed with those providers, and we make no warranties regarding their performance.

  • Xcel Padel's total liability for any claim arising from or related to the Services or these Terms is limited to the amount actually paid by you to Xcel Padel in the 12 months preceding the event giving rise to the claim (or $100 if no payments have been made).

  • We provide the Services "as is" and "as available" without any warranty of any kind, either express or implied, except for any warranties which are incapable of exclusion by law.

  • Applicable law may not allow the limitation of certain warranties or liabilities, so some of the above limitations may not apply to you in whole or in part -- in such cases, Xcel Padel's liability will be limited to the maximum extent permitted by applicable law.

 

14. Termination

  • Xcel Padel reserves the right to suspend or terminate your account or your access to some or all of the Services at any time, with or without notice, for any violation of these Terms or of any other policy, or for any other behavior that we, in our sole discretion, believe is harmful to the interests of Xcel Padel, our users, or our community.

  • For example, without limitation, we may terminate your membership or online account if we determine that you have engaged in fraud, abuse of booking privileges, harassing behavior, or any action that violates our Code of Conduct or undermines the integrity of our Services.

  • If your account or membership is terminated due to a breach of these Terms or misconduct on your part, you will not be entitled to any refund of fees paid.

  • After termination, you must cease all use of the Services, and any provisions of these Terms which by their nature should survive termination (such as liability waivers, indemnification, intellectual property provisions, and dispute resolution clauses) will continue to remain in effect.

  • You are free to discontinue use of the Services and/or cancel your account at any time. If you wish to cancel your membership, please refer to Section 6 (Memberships, Payments, and Refunds) for the required notice and procedure.

  • Termination of your account will not relieve you of any obligations to pay any outstanding fees or charges owed.

 

15. Changes to the Terms

  • We may update or modify these Terms from time to time at our discretion. If we make material changes, we will post the updated Terms on our website (and update the "Last updated" date at the top).

  • In certain cases, we may also notify you of significant changes via email or through a notice on our site or booking platform, especially if required by law.

  • It is your responsibility to review these Terms periodically.

  • Your continued use of the Services after any changes to the Terms are posted (and after the effective date of any notified changes) will signify your acceptance of those changes.

  • If you do not agree to the revised Terms, you must stop using our Services and, if applicable, cancel your membership or account as per the termination provisions above.

 

16. Governing Law and Dispute Resolution

  • These Terms and any disputes arising out of or related to these Terms or the Services will be governed by and construed in accordance with the laws of the State of Florida, USA, without regard to its conflict of law principles. This governing law applies no matter where you live or where you use the Services.

  • You agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services shall be resolved exclusively in the state or federal courts located in Florida.

  • Specifically, if not otherwise specified by law, any legal action or proceeding must be brought in the courts of appropriate jurisdiction in the State of Florida (and, in particular, for disputes related to our Westlake club, in the courts located in Florida that have jurisdiction over Westlake/Palm Beach County).

  • You consent to the personal jurisdiction of these courts and waive any objections on the grounds of inconvenient forum or otherwise.

  • Notwithstanding the foregoing, Xcel Padel reserves the right to seek injunctive or equitable relief in any jurisdiction if necessary to protect its intellectual property or enforce certain provisions of these Terms.

  • If you are accessing the Services from outside the United States, you do so on your own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. However, the choice of Florida law as governing law will still apply to these Terms.

 

17. Linked Policies

The following additional policies are incorporated by reference into these Terms. By agreeing to these Terms, you also agree to the terms of the following policies, which you should review carefully:

  • Privacy Policy: Explains how we collect, use, and protect your personal information.

  • Booking & Cancellation Policy: Details the procedures and rules for reserving courts/classes and canceling bookings, including deadlines and fees (summarized in Section 7 above).

  • Cookie Policy: Provides information on how we use cookies and similar tracking technologies on our website, and your choices regarding them.

  • Membership & Participation Waiver: This is the waiver agreement (often agreed to via the Playtomic app or in person) that covers assumption of risk, release of liability, and code of conduct for participating in Xcel Padel activities. Key provisions of the waiver are reflected in Sections 8 and 9 above. You must agree to the waiver to participate in on-court activities or club events.

  • Each of these policies is available on our website or at our club upon request.
