  • It applies to all personal data collected through our website (xcelpadel.com), mobile and web applications, the Playtomic booking platform, and any related services or offline interactions with us (collectively, the "Services").

  • By using the Services, you agree to the collection and use of your information as described in this Policy and in accordance with applicable U.S. federal and state privacy laws (including California's CCPA) and FTC guidelines.

  • This Privacy Policy is an integral part of Xcel Padel's Terms & Conditions, Booking & Cancellation Policy, and Membership Waiver (Playtomic Waiver), which we encourage you to read for additional context on our practices and your obligations.

2. Information We Collect

We collect various types of information from and about you in order to provide and improve our Services. This includes:

  • Personal Identifiers: Contact and account details such as your full name, email address, telephone number (including WhatsApp if provided), postal address, date of birth, and other identifiers you provide when creating an account or membership. If you register for Services through Playtomic or another platform, we may receive similar identifiers from those third parties.

  • Technical & Usage Data: Information about your device and how you use our website and apps. This includes IP address, browser type, device identifiers, and pages or screens you view and interact with. We collect this data through cookies and similar technologies (e.g. Google Analytics, Google Tag Manager, Meta Pixel) to understand site performance and usage patterns. We also log referring URLs, timestamps, and technical information about your connection.

  • Marketing & Communication Data: Data about your engagement with our communications and online ads. For example, if you subscribe to our newsletter or promotional texts, we collect your communication preferences and how you interact with our emails or SMS (open rates, clicks) via our marketing platform (e.g. Klaviyo). We may also receive analytics on online ad performance from partners like Meta (Facebook/Instagram) and Google (Ads, Tag Manager, Search Console) regarding how you respond to our ads.

  • Booking & Activity Data: Information related to your reservations, memberships, and activities at Xcel Padel. This includes court bookings, class or event registrations, match history, tournament participation, wellness service appointments, and social interactions facilitated through our official booking partner platform (Playtomic). If you use the Playtomic app or web portal to book courts or join activities, Playtomic will collect and share with us relevant details such as your name, contact info, booking details, and club membership status needed to manage your reservations.

  • Payment Information: Financial information you provide for purchases, such as membership fees, court reservations, or in-club purchases. Payments on our website are processed by third-party processors like Stripe or via Playtomic for in-app bookings. We do not store your full credit/debit card numbers or CVV codes on our servers. We may retain non-sensitive details like the cardholder name, billing address, the last four digits of your card, payment method, transaction date, and amount for record-keeping. All card transactions are encrypted and handled securely by Stripe or Playtomic, and their privacy policies govern the use of your payment data.

  • Offline Information: Information collected in person or through offline means. For instance, if you register at our club, sign a waiver or membership form on-site, enter a competition, or provide information over the phone, we may collect personal and contact details through those offline interactions. We treat offline-collected data consistent with this Privacy Policy and combine it with online data where applicable.

  • Photos and Media: Images or video footage that may identify you, captured during events or at our facilities. (See Content & Media Release below for details on how we handle these.)

We collect only what is necessary for the purposes described in this Policy. You can choose not to provide certain information; however, doing so may limit your ability to use some of our Services (for example, we need contact and payment info to process bookings or memberships).

3. How We Collect Information

We collect personal information from you through several methods:

  • Directly from You: Most information is provided directly by you. You give us personal identifiers and contact details when you create an account, sign up for a membership, book a court, subscribe to our newsletter, fill out forms (online or on paper), contact us by email/phone, or communicate with us in person.

  • Through Our Websites and Apps: When you use our website or mobile app, we (and authorized third parties) use automatic data collection technologies to gather Technical & Usage Data. This includes cookies, pixels, and similar tracking technologies placed on your browser or device. For instance, we use Google Analytics and Google Tag Manager to track how you use our site, which pages you visit, and to analyze usage trends.

  • From Third-Party Platforms and Partners: If you interact with Xcel Padel through a third-party platform, we may receive information from them. For example, if you use the Playtomic app to book a court at Xcel Padel, Playtomic will share the booking details and your profile information with us to facilitate your reservation.

  • Offline Interactions: We may also collect data when you engage with us offline. This includes when you sign membership agreements or waivers in person, register for tournaments or events at the club, or provide information during a phone call or at a front desk.

  • Social Media and Public Sources: If you tag us on social media or post content about Xcel Padel that is public, we may view or engage with that information (for example, sharing a photo you tagged us in, with your permission).

  • Collection of Geolocation Data: Some of our third-party integrations might access location data. For example, the Playtomic app or our facility's GoTab ordering system may use your device's location to show nearby clubs or enable certain location-based services. You will typically be asked to grant permission for location access via your device.

4. Use of Information

We use the information we collect for the following purposes, all aimed at providing a safe, efficient, and personalized experience:

  • Providing and Managing Services: We use personal information to create and manage your account, process court bookings, schedule classes or wellness services, and administer memberships and related benefits. This includes verifying your identity when you log in, remembering your bookings, and communicating with you about your reservations, lessons, or events you signed up for.

  • Fulfilling Transactions and Payments: We use your information to take payments and deliver the products or services you purchase. For example, when you book a court or buy a membership, we use your payment details to charge the fee (through Stripe or Playtomic) and confirm the transaction. We also use transaction data to track and record payments, provide receipts, and handle any refunds or cancellations in line with our Booking & Cancellation Policy.

  • Communications and Customer Support: We use your contact information (email, phone) to send service-related communications. These include confirmations and reminders for your bookings, important updates about your membership or our facilities (e.g. closures, schedule changes), and responses to inquiries you send us.

  • Marketing and Promotions: We use personal and preference data to send you promotional content, but only in accordance with your communication preferences and applicable law. This may include newsletters, special offers, event announcements, club updates, and surveys. We use platforms like Klaviyo to manage email and SMS campaigns. We may also use Meta's advertising services (Facebook/Instagram ads) and Google Ads to show you targeted advertisements for Xcel Padel on those platforms.

  • Analytics and Improvement of Services: We analyze usage data and feedback to understand how our Services are used and to improve them. For example, we review Google Analytics data to see aggregate trends like which website pages are most popular or at what times of day our app is most active. This helps us optimize site content, navigation, and overall user experience.

  • Personalization: To provide a premium and personalized experience, we may use your data to customize certain elements of our Services for you. For instance, we might remember your preferred court times or instructors, show you content in your preferred language, or suggest events that align with your past activities.

  • Security and Club Policy Enforcement: We use information to maintain the safety and integrity of our Services and physical facilities. This includes monitoring for and preventing fraudulent activity, security breaches, and misuse of our website or app. We may use certain data (like device information or login history) to detect suspicious behavior on your account.

  • Legal Compliance: We process personal information as needed to comply with our legal obligations, such as maintaining financial records for tax and accounting purposes, satisfying valid law enforcement requests, or honoring your privacy rights requests.

  • Any Other Purpose With Your Consent: If we intend to use your information for a purpose not described in this Policy, we will explain it to you at the time of collection and, if required, obtain your consent.

We do not use your personal data in ways that are incompatible with the above purposes without your knowledge. We do not engage in automated decision-making or profiling that produces legal effects concerning you, except as described (targeted advertising and personalization as noted, which you may opt out of as described below).

5. Content & Media Release (Photography & Media Use)

  • Photography & Video at Club Events: By participating in Xcel Padel activities or visiting our facilities, you acknowledge and agree that we (or our authorized representatives) may capture your image, likeness, or voice in photographs, video, or other media. Xcel Padel regularly documents its events, classes, tournaments, and daily club life for promotional and archival purposes.

  • Consent to Use and Rights: You grant Xcel Padel the right to use and publish such photos or videos without any compensation to you. All such media content is considered the property of Xcel Padel, and may be edited, reproduced, published, or distributed at our discretion. You understand that you will not have approval rights over the final product, and you waive any claims related to the use of your likeness, including claims of privacy or rights of publicity, insofar as permitted by law.

  • Minors: If you are under 18, or if you are a parent/guardian of a minor who participates in our programs or events, special considerations apply. We do not intentionally capture or use media of minor children without parental or guardian consent. Our Membership & Participation Waiver (which a parent/guardian must sign for minors) includes consent for photography/videography of the minor during club activities.

  • Opting Out of Media: We understand some individuals may prefer not to be photographed or recorded. If you do not wish to appear in our promotional media, please let us know by contacting us or by informing a club official at the time of the event.

  • Use of User-Provided Content: If you voluntarily share content with us (for example, submit a testimonial, tag us in a social media post, or provide a quote or review), you allow us to repost or reference that content for promotional purposes, using your name or social media handle as attribution unless you request anonymity.

By attending our events or being a member of our club, you understand and accept this Content & Media Release.

6. Data Sharing and Disclosure

We value your privacy and only share your personal information with third parties for legitimate purposes. We do not sell your personal data for money. However, we do share information in certain circumstances, as detailed below:

Service Providers (Processors): We share personal data with trusted third-party companies who perform services on our behalf and under our instructions. These providers are bound by contractual privacy and security obligations to protect your data and use it only for the agreed-upon purpose. Key service providers include:

  • Stripe, Inc.: We use Stripe to process online payments for memberships, bookings, and purchases. When you enter your payment details, that information is transmitted directly to Stripe. Stripe handles your card information in compliance with PCI-DSS security standards. Xcel Padel receives confirmation of payment and limited details but not your full card number or security code.

  • Playtomic (Playtomic S.L.): Playtomic is our official booking and club management platform. If you use Playtomic to book courts, join matches, or manage your club membership, your personal data is collected by Playtomic and shared with Xcel Padel so we can reserve your spot and administer your membership.

  • Wix.com Ltd.: Our website is hosted and built on the Wix platform. Therefore, any data you enter on our website (contact forms, account info, etc.) is stored on Wix's servers. Wix, as our website hosting and content management provider, may have access to the data for hosting and maintenance purposes.

  • Klaviyo, Inc.: We use Klaviyo to manage our email and SMS communications. If you subscribe to our newsletter or provide consent to receive promotional texts, we share your contact details and certain marketing preferences with Klaviyo's platform.

  • Meta Platforms, Inc.: We integrate tools from Meta (the company behind Facebook, Instagram, Messenger) for advertising and analytics. This includes the Meta Pixel on our website, which allows Meta to collect information about your visit. We share hashed or device information with Meta to create custom audiences and deliver targeted Xcel Padel ads to you on Facebook/Instagram.

  • Google LLC: We use various Google services (Analytics, Ads, Tag Manager, Search Console) that may involve sharing data with Google. Google Analytics uses cookies and tracking code on our site to collect data about traffic and usage patterns. We have enabled IP anonymization in Google Analytics, which truncates your IP address before storage or processing, adding an extra layer of privacy.

  • GoTab Inc.: If our club offers food, beverage, or pro-shop ordering through the GoTab system, your order and payment are handled by GoTab. GoTab will share with us the necessary information to fulfill your order (such as your name and the items you purchased, time of order).

  • Other Vendors: We may employ additional vendors for specialized services such as IT support, cloud storage, scheduling software, marketing analytics, etc. These vendors will have access to data only to the extent needed to perform their functions and are prohibited from using it for other purposes.

Other Sharing Circumstances:

  • Business Partners and Affiliates: Xcel Padel does not currently share personal information with third parties for their own direct marketing purposes without your consent. If we ever partner with another company to offer joint promotions, events, or services, we will let you know at the time of collecting your information, and you'll have the choice to participate.

  • Legal Requirements and Protection of Rights: We may disclose personal information when we believe in good faith that such disclosure is required to comply with a legal obligation (such as a subpoena, warrant, court order, or similar legal process). We may also share information if we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person.

  • Business Transfers: If Xcel Padel is involved in a significant business transaction such as a merger, acquisition by another company, reorganization, or sale of all or a portion of its assets, personal information held by us may be among the assets transferred to the new owner.

  • With Your Consent: Apart from the cases above, we will share your personal information with third parties only if you have given us explicit consent to do so.

Important: Whenever we share your information with third parties, we only share the minimum necessary information for that purpose. We also require any third party that handles personal data on our behalf to implement proper security measures.

  • Analytics Cookies: We use Google Analytics and similar tools which set cookies to collect information about how visitors use our site. This includes data on which pages are visited, how long users stay, how they got to our site, and what features they use.

  • Advertising Cookies: These cookies are used by us and our advertising partners (like Meta and Google Ads) to track your browsing habits and activity on our site in order to show you relevant advertisements on other sites or social media.

  • Other Third-Party Technologies: If we embed content from third-party services (for example, a YouTube video or an Instagram feed) or use social media sharing buttons, those third parties may set their own cookies on your browser.

Your Choices for Cookies and Tracking:

  • Browser Settings: You can set your web browser to refuse some or all cookies, or to alert you when cookies are being set. Please note that if you disable or delete cookies, our website may not function optimally.

  • Cookie Banner & Preferences: When you first visit our site, you may see a cookie consent banner. We will obtain your consent for non-essential cookies (like analytics and advertising cookies) where required by law.

  • Third-Party Opt-Outs: For Google Analytics, you can opt out by installing the Google Analytics Opt-out Browser Add-on. For Google's advertising cookies, Google provides Ads Settings where you can control personalized ads. To opt-out of Meta (Facebook) Pixel-based ads, you can adjust your ad preferences on Facebook and Instagram.

  • Do Not Track Signals: Some browsers transmit "Do Not Track" (DNT) signals to websites. At this time, our website does not respond to DNT signals in any standardized way.

  • Mobile Devices: On a mobile app, you can usually limit ad tracking by adjusting your device settings. For example, on iOS devices, go to Settings > Privacy & Security > Tracking to disallow apps from tracking you.

8. Data Retention & Security

Data Retention: We retain personal information only as long as necessary to fulfill the purposes for which it was collected, or as required by law. The exact duration varies by data type and usage:

  • Account and Profile Information: We keep your account data for as long as you maintain an account with us. If you terminate your account or membership, we may retain certain data for a limited period in case you reactivate or for record-keeping, unless you request deletion.

  • Booking and Transaction Records: We retain records of your bookings, purchases, and transactions for at least several years. This is necessary for financial auditing, tax compliance, and potential dispute resolution. Transactional records may be kept for 7 years to comply with U.S. tax and accounting regulations.

  • Marketing Data: If you are on our marketing list (emails/SMS), we will retain your contact and preference information until you unsubscribe or until after a period of inactivity. We may remove or anonymize your data after about 24 months of inactivity, or earlier if required by law.

  • Legal Hold: If we are dealing with a legal issue that involves your data, we will retain the relevant data until it is resolved, even if that extends beyond the normal retention period.

  • Anonymized Data: In some cases, we may anonymize your personal data (so it can no longer be associated with you) for statistical purposes. We reserve the right to retain and use such anonymous data indefinitely.

  • Authentication & Monitoring: Our systems are protected by authentication measures and we maintain logs of access to sensitive systems and monitor for unusual activities.

  • Network & System Security: We use firewalls, intrusion detection systems, and regular security scanning to guard against external attacks. Our website and database undergo periodic vulnerability assessments and updates.

  • PCI Compliance: For payment processing, we use Stripe which is PCI-DSS compliant. We do not directly handle or store sensitive credit card details on our servers to reduce risk.

  • Training and Policies: We train our staff on privacy and data security best practices. We have an incident response plan in place in case of a security breach.

Despite our precautions, please note that no method of transmission over the Internet or electronic storage is 100% secure. In the event of a data breach that affects your personal information, we will notify you and the appropriate authorities as required by applicable law.

You have certain rights and choices regarding your personal information. Xcel Padel is committed to respecting these rights and has processes in place to enable you to exercise them easily.

  • Opt-Out of Marketing: If you no longer wish to receive marketing emails or texts from us, you can opt out at any time. Email communications will contain an "unsubscribe" link at the bottom. For SMS messages, you can reply "STOP" to opt out.

We aim to respond to privacy requests within the timeframe required by law (for example, within 45 days for CCPA/CPRA requests). There is generally no fee for making a request, but repetitive or excessive requests may incur a reasonable fee.

Individuals under 18 are not permitted to purchase memberships or make bookings without parental involvement.

  • Club Participation of Minors: We allow minors to use our physical facilities only with the consent and, in some cases, supervision of a parent or guardian. A parent/guardian must sign our Waiver and Membership Agreement on behalf of any minor.

  • Parental Controls and Choices: If your child is a participant in our programs, as a parent you may review the personal information we have collected about your child, direct us to correct or delete it, and refuse to permit further collection or use of the child's information.

We do not use children's personal information for any marketing or advertising purposes. Any information collected about minors is strictly for operational purposes (e.g. scheduling classes, ensuring safety, tracking progress in a junior program, etc.) or legal compliance.

11. International Data Transfers

  • Xcel Padel is headquartered in the United States, and the majority of our data processing occurs in the U.S. If you are accessing our Services from outside the U.S., be aware that your personal information will likely be transferred to, stored, and processed in the United States or other jurisdictions where our service providers are located.

  • For European and UK Users: If you are in the European Economic Area (EEA), United Kingdom, or Switzerland, we will ensure that adequate safeguards are in place for transferring your personal data outside of those regions. This typically means we rely on Standard Contractual Clauses (SCCs) or other approved transfer mechanisms.
